Terms of Service
Last updated October 1, 2026
PlantHere is run by Brush Hunter Topco LLC, a Texas limited liability company, 2 Applewood Ct., The Hills, TX 78738 (“we”, “us”). By using PlantHere you agree to these terms. If you don’t agree, please don’t use it. Our Privacy Policy explains what we collect.
1. What PlantHere is
PlantHere suggests native plants for a spot in your yard, based on your ZIP code and the conditions you describe. The plant finder is free. It is a beta: it covers Austin and the Hill Country, it will change, and it may sometimes be unavailable or wrong.
2. Suggestions, not a site assessment
Our recommendations are general information to help you plan. They are not a professional site assessment and are not advice from a landscape architect, arborist, engineer or other licensed professional. We have not seen your property. Soil, drainage, slope, shade and microclimate vary from one corner of a yard to the next, and sun readings from your answers or photos are estimates.
Before you plant, check what matters for your property: call 811 before digging, and follow your HOA rules, city ordinances, and any setback, utility-easement or fire-safety requirements. Nursery stock and container sizes change; what we show as “in stock” may not be on the shelf when you arrive. If we have a business relationship with a nursery or landscaper we show you, we will say so next to it.
3. Plant safety and toxicity
Some native plants are poisonous to people, pets or livestock, and some cause allergies or skin reactions. We show toxicity notes where we have them, but our list is not complete. A plant without a warning is not necessarily safe. Before planting anywhere children, pets or livestock can reach, check each plant with a reliable source such as your vet, the Texas A&M AgriLife Extension office, or Poison Control (1-800-222-1222). If you suspect a poisoning, call Poison Control or a vet right away.
We screen every recommendation against Texas and federal noxious-weed and invasive-species lists. If you ever see an invasive plant suggested, please tell us with the “Wrong plant?” button.
4. Using PlantHere fairly
Please use PlantHere for planning your own yard, or (on Green Thumb Pro) your clients’ properties. Don’t:
- copy, scrape or bulk-download the plant database, rankings or descriptions, or use them to build a competing product;
- flood the feedback button or try to overload, break or get around limits on the service;
- upload photos you don’t have the right to use, or photos of other people; or
- use PlantHere for anything unlawful.
5. Who owns what
The plant database, the way it ranks plants, the plant descriptions and the PlantHere name belong to us. Plant photos belong to their photographers and are shown under the licenses credited with them. You may print, save and share your own results. Photos you upload remain yours; you let us process them only to give you your results.
6. Paid features (when they are available)
The paid site survey is not switched on yet. This section applies once it is. Payments are processed by Stripe. A survey uses an AI model from Anthropic to read your photos; it may only choose from plants our database has already cleared for your area, but its reading of your photos can still be wrong.
Credit packs (one-time purchases):
- Newbie — $5.99 for 1 survey
- Native Planter — $12.99 for 3 surveys
Monthly plans (renew automatically each month until you cancel):
- Green Thumb — $19.99 a month, up to 20 surveys in any 30 days
- Green Thumb Pro — $90 a month, up to 100 surveys in any 30 days
Fair use on plans. Each plan has a stated survey limit, and we name the number rather than call it “unlimited.” A plan is for your own household or, on Green Thumb Pro, your own business and its clients. Please don’t share an account or resell surveys. If an account is plainly being shared, we may pause it and will contact you first.
Refunds.
- Unused credits from a one-time pack can be refunded within 14 days of purchase. Contact us (below).
- If a survey fails and returns no results, the credit goes back to your balance.
- You can cancel a monthly plan at any time. It stays active until the end of the period you have paid for and then stops. We don’t refund partial months.
Prices may change; a change never affects a purchase you have already made. Applicable taxes may be added.
7. No warranty
PlantHere is provided “as is.” We work hard to make it accurate, but we don’t promise that every recommendation is right for your site, that a plant will thrive, or that the service will always be available.
8. Limit of liability
To the extent the law allows, we are not liable for plants that fail, the cost of plants or labor, property damage, or any indirect or consequential loss arising from your use of PlantHere. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if that is greater.
9. Texas law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Travis County, Texas.
10. Changes and ending use
We may update these terms; the date at the top will change, and if you have a paid account we will tell you about material changes before they take effect. You can stop using PlantHere at any time. We may suspend access for anyone who breaks these terms.
